THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.200 of 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) A common order was passed in W.P. Nos. 25110 and 25271 of 2009 dated 4.12.2014. In W.P. No. 25110 of 2009, the third respondent was Sri Datla Govinda Raju. By order dated 4.12.2014, the learned Single Judge relegated the petitioner therein to the statutory remedy of an appeal, and directed the 2nd respondent to dispose of the appeal within a period of three months. Aggrieved thereby, the legal representatives of the deceased third respondent preferred W.A. No. 808 of 2015 and a Division Bench of this Court, by its order in W.A. No. 808 of 2015 dated 31.8.

2015, set aside the order under appeal on the ground that it was passed against a person who was no more. The matter was remanded to the learned Single Judge for his consideration afresh. We are informed that W.P. No. 25110 of 2009 is still pending on the file of this Court. The appellant herein is also one of the legal heirs of the third respondent-Sri Datla Govinda Raju. He now seeks an order similar to the one passed in W.A. No. 808 of 2015 dated 31.8.2015. Following the order passed in W.A. No. 808 of 2015 dated 31.8.2015, this writ appeal is also disposed of. The order under appeal is set aside and W.P. No. 25271 of 2009 is restored to file and shall be listed along with W.P. No. 25110 of 2009. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
