THE HON'BLE SRI JUSTICE SAMBASIVARAO NAIDU T.R.C.M.P. No.231 OF 2022 ORDER:
Heard. This transfer C.M.P. has been filed by the petitioner/wife of respondent seeking transfer of O.P. No.2l of 2022 from the Court of Senior Civil Judge, Wanaparthy to the Court of Senior Civil Judge, Kukatpally.

As per the averments made in the petition, it seems the respondent who is a medical practitioner and resident of Pebbair Village, filed divorce petition before Senior Civil Judge, Wanaparthy.

As per the averments made in the present petition, the petitioner herein has filed a Criminal Case under Section 498-A, I.P.C. and another case under Domestic Violence Act before Kamareddy Police, wherein charge sheet yet to be filed. As per the track report filed by the Counsel for the petitioner, the registered notice addressed to respondent returned unserved with an endorsement no such person is available in the given address.

Learned Counsel for the petitioner has filed proof of service and it shows that a notice was sent to the counsel
representing the respondent herein in the divorce petition, nobody represented the respondent. Learned Counsel has submitted that the petitioner being lady, cannot travel from Hyderabad to Wanaparthy for all heatings for contesting the said petition and sought for transfer of the said O.p. to family Court at Kukatpally.

In view of the above stated circumstance the petition is allowed. O.P.No.21 of 2022 on the file of Senior Civil Judge, Wanaparthy is withdrawn and transferred to Senior Civil Judge, Kukatpally. Senior Civil Judge, Wanaparthy is directed to transfer the entire record in O.p.No.21 of 2022 by duly indexing the same under intimation to the respondent. The Miscellaleous Applications, if any, pending shall stand closed.
