THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27157 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ, Order or direction more particularly one in nature of Writ of Mandamus declaring the action of the 1st respondent in rejecting petitioner application for Occupancy Certificate bearing file No. 2/C21/11800/2019-OC dated 31.07.2019 based on the suggestions of the Respondent Nos. 2 and 3 herein dated 31.07.2019 as illegal, arbitrary, discriminatory and violative of sec. 429 and 455 of the Greater Hyderabad Municipal Corporation Act, 1955 and consequently direct the 1st respondent herein to grant Occupancy Certificate as prayed for without reference to Letter bearing Lr. No: El/1111/ 2017 dated 06.11.2018 issued by the Collector and District Magistrate, Ranga Reddy District and pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Heard Sri S.Sridhar, learned counsel appearing for the petitioner and Sri Sampath Prabhakar Reddy, learned standing counsel appearing for the respondents. Perused the material available on record.

When the matter is called, it is submitted by learned counsel for both sides that the issue in the present writ petition is squarely covered by the orders, dated 02.12.2019, in W.P.Nos.25385 of 2019 & 25389 of 2019 of this Court,

TA,J W.P.No.27157 of 2019 wherein insisting of No Objection Certificate from the revenue officials is not required.

Following the said orders and for the reasons stated therein, this Writ Petition is also allowed in terms thereof, by setting aside the order impugned. There shall be no order as to costs.

Office to enclose copies of the orders, dated 02.12.2019, in W.P.Nos.25385 of 2019 & 25389 of 2019 to this order. 6.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
