THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Crl.P.M.P.Nos.8249 and 8250 of 2015 in Crl.P.No.1489 of 2011 & CRIMINAL PETITION No.1489 of 2011 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.10 of 2011 of Gangadhara Nellore police station, Chittoor District.
Along with the petition, the 2nd respondent/de facto complainant filed Crl.P.No.8249 of 2015 to compound the offences as mentioned in First Information Report and Crl.P.No.8250 of 2015 is filed both parties seeking to record the compromise.
On the report of the 2nd respondent/de facto complainant, police registered the above crime against the petitioners/A-1 to A-3 for the offences punishable under Sections 323 and 506 read with 34 IPC and Section 3 (i) (x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Both parties are present and they are identified by their respective counsel.
Heard both sides and perused the record.
It is submitted by both parties that at the intervention of elders they amicably settled the dispute and hence, compromise may be recorded and criminal proceedings in the above crime may be quashed.
Having regard to the above submission and considering the fact that the parties have amicably settled the dispute among themselves out of Court and no useful purpose will be served even if the parties
are driven to the trial as they compromised, and following the decision reported in Gian Singh v. State of Punjab and another[1] Crl.P.M.P.Nos.8249 and 8250 of 2015 and Crl.P.No.1489 of 2011 are allowed and compromise is recorded and consequently, proceedings in Crime.No.10 of 2011 of Gangadhara Nellore police Station, Chittoor District against the petitioners/A-1 to A-3 are hereby quashed.
