Heard.

The petitioner is a fair price shop dealer of Shop No.22 situated at B.B.Patnam, Rolugunta Mandal, Visakhapatnam District. The petitioner questions the said suspension on the ground that he has not been issued any notice and that suspension can be made only in the event of conviction of a dealer and not merely on the basis of criminal case registered against him. To the extent of power of suspension, I am not inclined to accept the said contention as the suspension pending enquiry is within the jurisdiction of the 3rd respondent. However, the petitioner is entitled to show cause as to why suspension deserves to be revoked by giving a detailed explanation with respect to the ground on which he is placed under suspension.

The petitioner is, therefore, at liberty to submit explanation to the 3rd respondent and after receipt of such explanation, the 3rd respondent shall consider the same and pass appropriate orders as to whether the suspension of the petitioner requires to be continued or revoked, expeditiously preferably within two weeks from the date of receipt of petitioner's explanation. Accordingly, the Writ Petition is disposed of. No order as to costs.
