THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 27066 of 2019 ORDER:

This Writ Petition is filed for the following relief: "....to issue an appropriate Writ, order or direction more particularly one in the nature of a writ of Mandamus declaring the inaction of the Respondents particularly Respondent No. 3 in not releasing the Mortgage deed/bonds in respect of the lands of the petitioners total admeasuring Acs.7.01 Gts. forming part of Sy.Nos.143/e/3, 144/4, 146/7, 146/8, 143/e/10 and 144/2, 143/e/4, 144/3/1 situated at Idikuda Village, Chandur Mandal, Nalgonda District despite the Government waived off the loans obtained by the petitioners from the 3rd respondent under Loan Waiver Scheme, vide G.O.Rt.No.

492, Social Welfare (SCP-I) Department, dated 07/07/2009, as being illegal, arbitrary and unconstitutional, violative of Articles 14, 21 and 300-A of the Constitution of India apart from being contrary to G.O. Rt..No.492, Social Welfare (SCP-I) Department, dated 07/07/2009 and violative of principles of natural justice, consequently direct the 3rd respondent to forthwith release the mortgage deeds/bonds in respect of the said lands of the petitioners by issuing clearance letters to Registering Authorities i.e., Respondent No 5 herein...." When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue raised in the present Writ Petition is squarely covered by the order dated 13.11.2015 passed by this Court in W.P.No.24590 of 2015.

Learned Government Pleader for Social Welfare appearing for respondent No.1 and learned Standing Counsel for the Corporation appearing for respondent Nos. 2 and 3 do not dispute the same. In view of the above, the writ petition is disposed of with the direction to the respondent authorities to consider the application

dated 14.08.2019 submitted by the petitioner in terms of the order dated 13.11.2015 passed by this Court in W.P.No.24590 of 2015 and take necessary steps within a period of six weeks from the date of receipt of a copy of this order.

Office to enclose a copy of the order dated 13.11.2015 passed by this Court in W.P.No.24590 of 2015 to this order. Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs.
