THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.25671 OF 2017 ORDER:

Heard the learned counsel for the petitioner and the learned Standing Counsel for the second respondent.

It is the case of the petitioner that he is doing business in the name of Sri Ambika Steels in the premises situated in Survey No.860, Kalyan Nagar Colony, Kaulkacherla Village and Mandal, Ranga Reddy District, by paying the licensee fee every year to the second respondent. While so, he received a notice from the second respondent on 14.06.2017 asking him to remove the shop with a threat to take further action in the case of non-removal. The petitioner submitted a reply on 17.06.2017 and in spite of the same, another notice was received on 19.06.2017 followed by the impugned notice on 27.07.2017, against which the present Writ Petition is filed.

Since the subsequent notice dated 27.07.2017 is challenged in the present Writ Petition, this Court is not inclined to go into the merits of the case but dispose of the Writ Petition with a direction to the second respondent to consider the petitioner's reply dated 17.06.2017 and pass appropriate orders in accordance with, if necessary, after hearing the petitioner. Till such time, no coercive steps shall be taken against the petitioner.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
