HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.9508 OF 2014

ORDER

This writ petition is filed seeking to declare the action of the 5th respondent in suspending the petitioner v i d e proceedings dated 4.3.2014, as arbitrary and illegal.

The petitioner was appointed as Junior Assistant in the 5th respondent-Temple. Based on certain charges of misappropriation, he was kept under suspension vide proceedings dated 4.3.2014. It seems that enquiry against the petitioner is going on.

Learned counsel appearing for the petitioner submits that the petitioner was kept under prolonged suspension without expediting the enquiry process which is causing much hardship to him.

On the other hand, learned counsel appearing for the respondent would submit that under Rule 6 of Office Holders and Servants Punishment Rules, 1987, if the enquiry is not completed within a period of six months from the date of suspension, the Commissioner, Endowment, has to review the suspension order.

Under these circumstances, the 2nd respondent

is directed to review the suspension order, complete the enquiry and pass appropriate orders within a period of three months from the date of receipt of a copy of this order.

Writ Petition is disposed of accordingly. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
