THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.4375 of 2009 ORDER:

The writ petition is filed by the petitioner seeking a writ of Certiorari calling for the records relating to the order, dated 16.02.2009 in E.O.P.No.9 of 2006 on the file of the Election Tribunal-cum-the Junior Civil Judge, Jacherla, and quash the same as arbitrary and illegal.

The petitioner herein challenged the order of the Election O.P., which is filed by the third respondent herein, whereby the said Election O.P., is allowed declaring that the election of the petitioner herein as Sarpanch of Kethireddypally is illegal and void, and the election was set aside and it was directed for recounting of votes and submit the same by 04.03.2009.

This Court, vide order dated 03.03.2009, while issuing Notice Before Admission, granted interim suspension for a period of six weeks and subsequently, it has been extended from time to time. In view of the interim suspension of the Order, dated 16.02.2009, in Election O.P.No.9 of 2006, and also in view of the fact that the term of the office of the petitioner is over, the subject matter of the writ petition has now become infructuous. Therefore, the writ petition is disposed of as infructuous. No costs.

Consequently, the miscellaneous petitions, if any shall also stand closed.
