HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.27048 OF 2019 ORDER:
This Writ Petition is filed to declare the action of the respondent Nos.1 to 3 in not proceeding with the investigation in relation to FIR No.374 of 2019 dated 26.06.2019 registered under Sections 417, 420, 468, 471, 408, 506 and Sec. 3(1)(r),(s), 3(2) (va) of SC/STs (POA) Amendment Act, 2015 against the 4th respondent, as being illegal, arbitrary, violation of Article 21 of the Constitution of India.
Heard Sri S. Daljith Singh, learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home submits that upon registration of crime, the authorities have in the course of investigation, examined L.Ws-1 to 7 and recorded their statements and further addressed letter to the Bank Manager, SBI, Godavarikhani on 02.11.2019 with a request to provide transaction details of accused bank account and also addressed a letter to the Manager, Bajaj Finance Limited, Corporate Office, Pune and the Manager of Lending Karts, Mumbai on 12.11.2019 with a request to furnish original documents, forged cheques of SBI account bearing No.35526373523.
Learned Assistant Government Pleader for Home further submits that after obtaining the documents from the bank authorities and other official respondents, the further investigation will be proceeded with.
Recording the said submission made by the learned Assistant Government Pleader for Home, since the authorities are investigating into the matter, no further orders are necessary from this court, except observing that the authorities shall investigate into the matter as expeditiously as possible. Subject to the above, the Writ Petition is closed. No order as to costs.
As a sequel thereto, the miscellaneous petitions pending, if any, shall stand closed.
