The petitioner assails the specific condition (road category) class-II mentioned in the Notice inviting e-bid of Central Public Works Department issued by the 5th respondent on the direction of the 4th respondent on 27.11.2019 vide NIT No.27/ EE/ Hyd-IV/ 04/ CE-Hyd/ 2019-20 to favour respondent No.6, as illegal and arbitrary.
Learned counsel for the petitioner submits that the Executive Engineer who issued the impugned Tender Notification has been transferred; and subsequently the 5th respondent (the present incumbent) issued a fresh tender notification, and therefore the learned counsel prays that the respondents may be directed to take a decision with respect to the tender notification issued on 27.11.2019 vide NIT No.08/ SE/ KCUPD/ 19-20. Inasmuch as there is no interim order passed in the writ petition, the writ petition is disposed of with a direction to the respondents to complete the tender process initiated vide Tender Notification dated 27.11.2019 referred to supra, at the earliest. No costs. Miscellaneous petitions, if any pending shall stand closed.
