HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.7175 of 2018 ORDER:

This Criminal Petition is filed by petitioners/A1 & A2 under Section 482 Cr.P.C, to quash the proceedings against them in Crime No.168 of 2013, of III Town Police Station, Visakhapatnam City, Visakhapatnam District, registered for the offences under Sections 406, 420, 468, 471, 120-A, 120-B IPC r/w 34 IPC against them and others.

Having regard to the fact that the investigation is in the nascent stage, this Court is not inclined to quash the proceedings. However, the investigating officer shall scrupulously follow the guidelines rendered by the Hon'ble Apex Court in Arnesh Kumar V. State of Bihar1 and also follow the procedure contemplated under Section 41-A Cr.P.C., during the course of investigation. Petitioners/A1 & A2 in turn are directed to cooperate with the investigating agency for smooth completion of investigation.
