THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 7875 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.178 /2022 on the file of Bijinapally Police Station, Nagarkurnool District, registered for the offences punishable under Sections 324, 420, 376 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.
The case against this petitioner is that he had asked the defacto complainant to transfer some money from their account, which they received towards land acquired, to his account. Thereafter, the victim went along with her two children with the petitioner and stayed for 15 days in a room. Thereafter, she came back and lodged the present complaint.

Learned Counsel for the petitioner submits that the allegations made in the complaint are highly improbable and deliberately made to extract money from the petitioner.

Keeping in view the transactions that have taken place between the petitioner and the victim and also for the reason of the defacto
complainant staying along with her two children in a rented room with the petitioner, this petitioner can be granted the relief of bail subject to the following conditions:
i) The petitioner/A1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, to the satisfaction of Judicial Magistrate of First Class at Nagarkurnool.
ii) The petitioner/A1, after release shall appear before the concerned Police Station on every Monday between 10.00 A.M. to 1.00 P.M. for a period of three months, for the purpose of investigation.
iii) After release the petitioner/A1 shall not in any manner try to contact either the victim or her family, failing which, the police are at liberty to seek cancellation of bail. iv) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
