THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11025 OF 2015 ORDER:

1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner/accused in C.C.No.5 of 2014 on the file of Principal Junior Civil Judgecum-Special Court for Land Grabbing (Proh.) Court, Visakhapatnam. 2 At the time of arguments, the learned counsel for the petitioner has sought permission of the Court to permit the petitioner to withdraw this Criminal Petition, with a liberty to avail the remedies available to him under law, including filing of petition under Section 70(2) Cr.P.C to recall the NBW issued against him on 16.09.2015.

3 Permission is accorded.

4. In the result, the Criminal petition is dismissed as withdrawn, granting the liberty as prayed for. However, the trial Court is directed to dispose of the petition to be filed by the petitioner under Section 70(2) Cr.P.C. on the same day in view of nature of the employment of the petitioner and in accordance with law. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed. __________________________ T. SUNIL CHOWDARY, J.
