THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4339 OF 2017 O R D E R :

The case of the petitioners is that they have been carrying on their respective business in Shop Nos. A-1, 11, 10, 15, 20 and 25 in Municipal Complex, Sircilla Town, Rajanna Sircilla District, which were allotted to them, on lease, pursuant to the auction conducted in 2007 and 2004. The lease was stated to have ended by May 2016. Hence, the 2nd respondent issued the notice dated 17.01.2017 putting the above-said shops to auction. Though the Writ Petition has been filed questioning the auction notice dated 17.01.2017, learned counsel for the petitioners submits that the petitioners will be satisfied if the representations made by them on 04.10.2016 and 16.03.2016 are considered in accordance with the rules.

Learned Standing Counsel for the 2nd respondent Sri N. Praveen Kumar is fair enough to submit that he has no objection if the request made by the learned counsel for the petitioners is considered.

The Writ Petition is therefore, disposed of with a direction to the 2nd respondent to consider the above-dated representations, dispose them of and communicate the decision taken thereon to the petitioners. This entire exercise shall be completed within four weeks from the date of receipt of a copy of this order. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
