THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28052 OF 2014 ORDER :

The grievance of the petitioner is that the 2nd is refused to receive the implead petition filed by the petitioner in the appeal S.R.No.4/11A/69 pending before the 2nd respondent. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

When the appeal is pending before the 2nd respondent, he is bound to receive the petition filed by the petitioner if the same is in order and has to decide the maintainability of the said petition, but he cannot straight away refuse to receive the petition filed by the petitioner. It is not known why the office of the 2nd respondent is not receiving the same.

In view of the same, without expressing any opinion on the merits of the case, the 2nd respondent is directed to receive the implead petition filed by the petitioner, if the same is in order and dispose of the same, in accordance with law.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 01.02.2017 kvs
