None of the offences punishable under Sections 427, 447 and 506 IPC are non-bailable, since all are bailable, and as such the question of seeking anticipatory bail under Section 438 Cr.P.C. does not arise from the very bar of its wording, thereby the criminal petition is disposed of, for remedy of the petitioners is to appear before the learned Magistrate under Section 444 read with 436 Cr.P.C. and make either written or oral request for bail, which the Court has to consider as it is a bailable offence with necessary sureties.
