THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY I.A.No.01 of 2018 IN/AND C.M.A.No.744 of 2010 ORDER:

I.A.No.01 of 2018 This miscellaneous petition is filed under Order XXIII Rule 3 of Civil Procedure Code (for short "C.P.C.") to record compromise in the suit O.S.No.38 of 2005 on the file of the Junior Civil Judge, Darsi, Prakasam District, as the matter is settled outside the Court and they entered into compromise and filed joint memo to that effect.

Appellant Nos.2 to 4 are present and the claim against the appellant Nos.5 to 13 was not pressed by the respondents herein/plaintiffs. The respondents/plaintiffs are also present and they are identified by their counsel, produced Photostat copies of aadhar cards in proof of their identity. When terms and conditions of compromise are explained in vernacular language, they are admitted to be true and correct.

On enquiry the parties stated that they settled the issue outside the Court due to intervention of elders and well-wishers and that the compromise is voluntary.

Therefore, in view of the terms of compromise, a compromise decree is to be passed.

Accordingly, the petition is allowed.

MSM,J Cma_744_2010 C.M.A.No.744 Of 2010 In view of the orders passed in I.A.No.01 of 2018, the present appeal is disposed of in terms of the compromise memo filed by both parties. No costs.

Registry is directed to annex a copy of the compromise memo filed by both parties, to the decree.

Consequently, miscellaneous applications pending if any, shall stand dismissed.
