HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35237 of 2016 ORDER:
1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself. There is no necessity to put the unofficial respondents on notice as this Court is not venturing to adjudicate the issue on merits. 2) The present writ petition is filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not taking any action against respondent Nos.4 to 7 for fabricating the house site pattas in an extent of Ac.0.03 cents each in Sy.No.168-2D2 of Kakarlapalli Village, Anantapur Mandal and District and not considering the representation dated 24.04.2016 as illegal, arbitrary and violative of principles of natural justice; and consequently direct respondent No.3 to hand over the vacant possession of the said plots after evicting respondent Nos.4 to 7. 3) Though the petitioner claiming various reliefs but his main grievance is that the representation dated 24.04.2016 made to respondent No.3 is not considered till date and hence seeks a direction.
4) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing respondent No.3 to dispose of the
representation dated 24.04.2016, in accordance with law after hearing all the concerned, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of the order, if the same is still pending consideration. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
