THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.36922 of 2015 ORDER :

Heard Sri P. Sridhar Rao, counsel for petitioner, and Sri B. Mayur Reddy, counsel for respondents.

2. The counsel for both sides agree that the issue in this Writ Petition is covered by the order dt.27.08.2015 in W.P.No.12250 of 2012 and batch.

3. For reasons alike, this Writ Petition is also allowed in terms of the said order, and the respondents are directed to conduct a fresh joint survey after written notice to petitioner by fixing dates for holding such survey. The petitioner or his representative shall be permitted to participate in such a joint survey and depending upon the outcome of the survey, the respondents shall take appropriate decision with regard to the actual distance for which the petitioner's bus was plied.

In the event it is found that the distance is less than what was assumed earlier, the respondents are entitled to reduce the hire charges proportionately and also shall reduce the fares of the passengers respectively.

The respondents shall complete this exercise within a period of two (02) months from the date of receipt of a copy of the order. It is needless to observe that till this exercise is completed the respondent shall not

recover any amount paid to petitioners towards alleged excess payments.

Accordingly the Writ Petition is disposed of with the above directions. No order as to costs.
