THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5879 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, the petitioner prays that the Hon'ble Court may be pleased to issue a writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in granting Form 2 B licence in premises bearing No. 9-1-24, Reddamma Complex, Navalurivari Street, Court Centre, Ongole, Pradasam District within 500 meters of predominantly residential area contrary to Rule 6 of the Andhra Pradesh Excise (Grant of License of Selling by Bar and Conditions of Licence) Rules 2005 as illegal and violative of the provisions of A.P.

Excise Act and Rules made there under and consequently direct not to grant licence to the 5th Respondent and pass such order or further orders as the Hon'ble Court feels deem fit and proper in the facts and circumstances of the case." Sri K.V. Bhanu Prasad, learned counsel appearing for the fifth respondent, states that under proceedings dated 28.03.2016 of the Commissioner of Prohibition and Excise, Andhra Pradesh, his client was permitted to shift the licensed premises to a new location after duly considering the objections raised.

In the light of the afore-stated development, the cause in this writ petition no longer survives for consideration on merits. The writ petition is accordingly closed leaving it open to the petitioner to challenge the subsequent proceedings in accordance with law if he is aggrieved thereby.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
