HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.23724 of 2018 ORDER:

The petitioner alleges interference of the 2nd respondent in his personal liberty by calling him to the police station at the instance of the 3rd respondent and directing him to settle the civil disputes with him.

Learned Assistant Government Pleader for Home produced written instructions stating that on the complaint of the 3rd respondent, GD entry was made and the petitioner was called to the police station. When the petitioner came to the police station, the 2nd respondent told him not to enter into the agricultural land of the 3rd respondent. Further on enquiry, it is disclosed that there is a civil dispute pending between the petitioner and respondent No.3 vide O.S.No.106 of 2016 on the file of Junior Civil Judge, Mylavaram. Earlier respondent No.3 gave complaint twice against the petitioner, upon which two cases were registered against the petitioner vide Cr.Nos 110 of 2017 and 67 of 2018 and in both cases investigation is completed and both cases are pending trial. It is denied that the 2nd respondent called the petitioner to the police station on 06-07-2018.

It is to be seen that in the written instructions respondent No.2 admits that he called the petitioner to police station and told him not to enter the agricultural land of the 3rd respondent. In fact, the 2nd respondent has no authority to direct the petitioner regarding possession of the land, unless he

receives any order from the civil Court. As on today, two crimes are pending against the petitioner and charge-sheets are filed.

In view of the same, the writ petition is disposed of directing the 2nd respondent is directed not to interfere with the civil disputes between the petitioner and the 3rd respondent, unless he receives any order from the civil Court. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
