HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45734 of 2016 ORDER:
The present writ petition is filed by the petitioners seeking to declare the action of the 2nd respondent in calling the petitioners to the police station in connection with CrimeNo.513 of 2016, as illegal and arbitrary, and consequently, direct the 2nd respondent not to interfere with the freedom of life and liberty of the petitioners. Heard and perused the material available on record. It main grievance of the petitioners is that though no case is pending against them and though they are not arrayed as accused in any crime, the Station House Officer, III-Town Police Station, Kurnool, is calling them to the police station and making them to sit from morning to the evening in the police station, on the pretext of enquiry in connection with Crime No.513 of 2016 registered by the 2nd respondent on the complaint lodged by the 3rd respondent. Taking into consideration the circumstances of the case, and the grievance of the petitioners, this Court is inclined to pass the following order:
The Station House Officer, III-Town Police Station, Kurnool, is directed to not to call the petitioners to the police station, without there being any crime registered against them for any cognizable offence.
Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
