HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 8551 OF 2009 ORDER:

This Writ Petition is filed challenging the memo No.598/G1/2009 dated 17.3.2009 issued by the second respondent in respect of plot No. 32 in S.No. 362 situated at H.No. 30-73/A, Khanajiguda Village, Alwal Municipality, Ranga Reddy District, admeasuring 300 square yards and in refusing to register the sale deed dated 18.10.1991, pending document in Plot No. 984/1991. A reading of the impugned order shows that the appeal preferred by the petitioner in relation to the objection of obtaining permission under Section 27 of the Urban Land (Ceiling and Regulation) Act, 33 of 1976, were dismissed by the second respondent on 19.7.2001.

Now, when the matter is taken up for consideration, the learned Government Pleader on the basis of written instructions submits that the land covered by the said document was treated as non-surplus land and the Government intimated to all the concerned departments including registration department vide letter No. A4/928/2010 dated 10.02.2012, not to insist for submission of ULC Clearance Certificate/NOC from the Special Officer and Competent Authority, ULC Hyderabad.

In view of the same, the third respondent is directed to act according to provisions of Registration Act, with respect to the document P.No. 984/1991 as and when the same is presented by the petitioner. Accordingly, the Writ Petition is disposed of. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
