THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 17362 OF 2013 ORDER:

This Writ Petition is filed to declare the action of the respondents in not passing orders on the representations of the petitioner dated 22-01-2013 and 22-05-2013 as illegal and arbitrary.

The case of the petitioner is that he is an ardent devotee of Bhagavan Sri Satya Sai Baba. Respondent No. 3-Trust was started by Bhagavan Sri Satya Sai Baba in the year 1972 and the same was registered. Certificate bearing No. 326 was issued by the Assistant Commissioner, Endowments Department, Hyderabad, and the same is being renewed once in every three years under the provisions of the Endowments Act, 1987. The Government of Andhra Pradesh exempted the Trust from certain provisions of the Act for a period of three years and the said exemption expired on 01-10-2009. Later, respondent No. 3 made a representation on 06-03-2010 requesting the Government to extend the exemption for a further period of three years. By G.O.Rt.No.649, dated 29-04-2010, the Government has exempted the Trust from the provisions of the Act for a further period of five years from 01-10-2009 though the representation dated 06-03-2010 is only for a period of three years. As invocation of Section 154 of the Act is per se contrary to law, the petitioner made representations on 22-01-2013 and 22-05-2013.

When the matter came up for hearing, learned counsel for the petitioner submits that the representation of the petitioner dated 22-05-2013 is not yet disposed of. On the other hand, learned counsel for respondent No. 3 submits that the petitioner is not an interested person and the petitioner has no locus standi and that there is no allegation of mismanagement by respondent No. 3.

In view of the above, the Writ Petition is disposed of directing respondent No. 1 to dispose of the representation of the petitioner dated 22-05-2013 and pass appropriate orders in accordance with law, as expeditiously as possible. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed in consequence.
