Aggrieved by the action of the 1st respondent in not passing stay order on the petitioner's stay petition in an appeal, which was filed against order dated 09.06.2018 in SRA No.1/2018/F2 passed by the 2nd respondent, this Writ Petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for respondents 1 & 2.
The grievance of the petitioner is that aggrieved by the order passed by the 2nd respondent in SRA No.1/2018/F2, dated 09.06.2018, he filed appeal along with stay petition before the 1st respondent on 25.06.2018. As no orders are passed, present Writ Petition is filed.
Learned counsel for the petitioner submits that during pendency of appeal and stay petition before the 1st respondents, the respondents are trying to evict the petitioner under the guise of orders dated 09.06.2018 passed by the 2nd respondent. In view of above facts and circumstances, without expressing any opinion on the merits of the case, since the appeal and stay petition filed by the petitioner is stated to be pending before the 1st respondent, the 1st respondent is directed to dispose of the appeal stay petition filed by the petitioner against order passed by the 2nd respondent in SRA No.1/2018/F2, dated 09.06.2018, as expeditiously as possible, preferably within a
period of three months from the date of receipt of a copy of this order. Till disposal of the same, the impugned order of the 2nd respondent dated 09.06.2018 in SRA No.1/2018/F2, is suspended.
With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
