THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9064 of 2021 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioners/Accused Nos.1 to 4 in Crime No.373 of 2021 of Khanapuram Haveli Police Station, Khammam District, registered for the offences punishable under Sections 8 (c ), 20 (b) of Narcotic Drugs and Psychotropic Substances Act, 1985, seeking bail. 2.

The petitioners/A1 to A4 were remanded to custody on finding 23 packets of Ganja amongst the 4 petitioners. 3.

Briefly stated, the case of the Prosecution is that the police found 8 packets in possession of 1st person weighing about 16 KGs (8 x 2 Kgs.); 5 packets in possession of 2nd person weighing about 10 kgs. (5 x 2 kgs.); 4 packets in possession of 3rd person weighing about 8 kgs (4 x 2 kgs.); and 6 packets in possession of 4th person weighing about 12 kgs. (6 x 2 kgs.), total ganja weighing about 46 kgs., worth Rs.4,60,000/-.

As seen from the case of the prosecution, individual seizures are less than the commercial quantity, further, charge sheet already filed, for which reason, the petitioners/A1 to A4 can be enlarged on bail on the following conditions.

i. the petitioners/Accused Nos.1 to 4 are directed to be released on bail on their executing personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each for likesum, among which one is local surety, to the satisfaction of II Additional Judicial First Class Magistrate at Khammam.

ii. The petitioners/accused Nos.1 to 4 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. and shall make themselves available for investigation as and when required.
