HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.7504 OF 2018 ORDER:

Crl.M.P.No.421 of 2018 is filed by the petitioner-accused to relax the condition imposed in the bail order in Crl.M.P.No.209 of 2018 in C.C.No.694 of 2017 dated 01.03.2018 passed by the learned II Additional Junior Civil Judge-cum-XX Metropolitan Magistrate, Cyberabad at Malkajgiri and to return the passport, and said Crl.M.P. is dismissed by order dated 21.03.2018. Aggrieved of the same, the present petition is filed.

As per the very bail order in Crl.M.P.No.209 of 2018, at the description in top of page No.2 it is mentioned as the petitioner is working in Dubai as bar tender in a hotel.

The present Criminal Petition is filed by the petitioner-accused to relax the condition of depositing the Passport before the lower Court and to give transit permission to leave to Dubai where he is working to continue his employment, otherwise likely to lose the job there.

This is a case relating to Crime No.220 of 2017 dated 24.03.2017, which is registered for the offences punishable under Sections 498-A, 420 & 406 r/w 109 IPC. The charge sheet is filed and taken cognizance and allotted calendar case in C.C.No.694 of 2017 which is pending for more than 1 1⁄2 year for trial.

Having regard to the above, rather that permission, that too with no assurance how the petitioner will be available to face the trial, to sub-serve the ends of justice the trial Court is directed to take up hearing before charges, if not charges already framed, and pass orders within one (1) week from the date of receipt of a copy of this order. If not entitled to discharge any of the accused, the trial Court shall on charges being framed proceed with trial day-to-day as per Section 309 Cr.P.C., and complete the trial and pronounce judgment on merits within a period of three (3) months from the date of receipt of a copy of this order. The petitioner is entitled to renew his request later if at all the trial is not completed.
