HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.23739 of 2018 ORDER:

Heard Mr.O.Kailashnath Reddy for petitioners and the learned Assistant Government Pleader for Revenue.

The petitioners are owners and possessors of agricultural land in Sy.Nos.211, 238 and 239 of Pathapalli Village, Yellanur Mandal, Ananthapur District. Sy.No.237 is classified as 'vagu' and abutting the land of petitioners. The petitioners in the instant writ petition complain inaction in disposing of representation dated 31.03.2018 and further state that respondents 2 and 3 ought to have prevented respondents 5 to 7 from either mining or extracting soil from Sy.No.237.

The writ petition was listed for admission on 11.07.2018. At the request of 3rd respondent, the writ petition is directed to be listed today for admission and also to enable the 3rd respondent to send instructions.

The Assistant Government Pleader places on record prompt reply of 3rd respondent and submits that respondents have personally inspected the site and found as follows :- " I further humbly submit that the above agriculture lands are located on the side of " Vagu" which is mean for rain water from the catchment area. I have inspected the land along with Mandal Surveyor and the Village Revenue Officer concerned on 11.07.2018. During the inspection of the land, it is noticed that the soil is not excavating and any mining operation is not done in the Government lands and

also noticed that during the inspection there is no scope causing erosion of land and causing damages to the land from the Government land."

The statement is placed on record.

The writ petition is disposed of by further directing the respondents 2 to 4 to ensure that soil in Sy.No.237 is not subjected to mining or extraction except in accordance with law. No order as to costs.
