THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.26804 OF 2015 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents 2 to 6, more particularly respondents 5 and 6, are not conducting fair and proper investigation in F.I.R.No.804 of 2013 registered on the file of the fifth respondent, though 22 months have been elapsed, as illegal and arbitrary and consequently direct the respondents 5 and 6 to file the charge sheet in the said crime. Heard and perused the material.

Learned counsel for the petitioner submits that though the case is registered being F.I.R.No.804 of 2013, the respondents 5 and 6 are not conducting the fair investigation and have not filed charge sheet even after long lapse of time. Hence, he prays this Court to direct the respondents 5 and 6 to complete the investigation fairly and properly, and also to file charge sheet after completion of investigation.

Learned Assistant Government Pleader for Home (Telangana) submits that the fifth respondent completed the investigation and filed the charge sheet before the Court concerned and that the same is pending before the Court for taking cognizance. He has also produced the written instructions received from the Sub Inspector of Police, P.S., S.R.Nagar, Hyderabad.

It is evident from the said written instructions that the charge sheet is already filed in the above crime before the Court concerned. Hence, recording the same, the writ petition is disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of.
