Konda Desinga Rao v. Munta Venkata Rao And 2 Others
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19749 OF 2004 ORDER :
This Writ Petition is filed seeking to issue a writ of certiorari calling for the records related to and connected with orders passed in MW No.28 of 2002, dated 7.6.2003 by the 3rd respondent and quash or set aside the same by holding them as arbitrary and illegal.
2.
Heard Sri Rama Rao Ganta, the learned Counsel for the petitioner and Sri P.Satya Manjula, Counsel for the respondents. 3.
The learned counsel for the respondent-workman submitted that the respondent-workman had given a complaint to the authorities under Minimum Wages Act complaining that the petitioner is not paying minimum wages and the authority has entertained the complaint of the respondentworkman and numbered it as M.W.No.28 of 2002 and adjudicated the matter and passed orders on 7.6.2003, directing the petitioner to pay a sum of Rs.2,535/- towards the difference of minimum wages. Challenging the same, the present Writ Petition is filed.
4.
The learned Counsel for the petitioner submits that the minimum wages Act has no application in respect of petitioner's establishment and the orders passed by the authority are totally incorrect, illegal and void. 5.
This Court, having considered the said submissions made by the parties is of the considered view that the petitioner could not point grave irregularity or illegality against the orders passed by the authorities under Minimum Wages Act and in the absence of the same, this Court cannot interfere with
the orders passed by the authority. There are no merits in the Writ Petition and the Writ Petition is accordingly dismissed. 6.
Miscellaneous Petitions pending, if any, shall stand closed. _____________________________ ABHINAND KUMAR SHAVILI, J 14th December, 2018 GS.
