2. Petitioner herein claims to be an assignee of Ac.2-20 guntas in Survey No.363 of Chandanvalli Village, Shabad Mandal,Ranga Reddy District. Alleging that the Government intends to construct double bed room houses in petitioner's lands and have laid a foundation stone for the said project, the present writ petition is filed.

3. Learned Government Pleader, on instructions, submits that Survey No.363 has an extent of Ac.73-25 guntas and petitioner is one of the

assignees. However, the foundation stone is stated to have been laid without disturbing the assignees as they are not at all concerned with the remaining scheduled Government land. The instructions further show that a notice would be issued to the assignee to show his allotment particulars and a survey will be conducted in the field to establish that the schedule land is different from the land assigned to the petitioner.

4. In view of the said instructions, I deem it appropriate to direct the third respondent to issue notice as stated in the instructions and ensure that his assigned land is not disturbed for the project undertaken by the Government without following due process of law.

With the above direction, writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
