THE COURT MADE THE FOLLOWING:

ORDER:

This writ petition is filed for the following substantive relief: "...to issue a writ of mandamus, declaring the action of the respondent in charging additional charges for belated payment on the arrears and insisting for execution of fresh agreement and free consumption deposit @ 500 per h.p. for restoring the power supply to the petitioner vide impugned memo No.CGM (Coml)/SE(C)DE/ (C)/ADE-I/Sick Unit/D.No.1463/11, dt.19.07.2011, as illegal and arbitrary."

Mr. C. Raghu, learned counsel for the petitioner, after arguing the case, submitted that his client is prepared to comply with the conditions stipulated in Memo No.CGM(Coml)/SE(C)DE/ (C)/ADEI/Sick Unit/ D.No.1463/11, dt.19.07.2011, if reasonable time is allowed to it. In view of this submission, while declining to interfere with the impugned Memo, the petitioner is permitted to comply with the conditions contained therein within two months. If such compliance is made by the petitioner, the respondent shall release the power supply. The writ petition is accordingly disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.10010 of 2012 shall stand disposed of as infructuous.
