THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7889 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1 & A2 seeking bail in the event of their arrest in connection with Crime No.124 of 2022 on the file of Jannaram Police Station, Ramagundam District, registered for the offences punishable under Section 306 read with 34 of Indian Penal Code. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against the petitioners is that the 1st petitioner being Principal and 2nd petitioner being clerk in Gayathri Junior College refused to handover the certificates of the deceased, though the fee was paid by his father-defacto complainant. For not returning the said documents, the deceased could not attend his EMCET counseling and depressed by the act of these petitioners committed suicide. 4.

As seen from the complaint, the acts of the petitioners are deliberate resulting in death of the student. However, keeping in view that the 2nd petitioner is a clerk, who followed the instructions of the 1st petitioner can be granted the relief of Anticipatory Bail in the event of his arrest, subject to the following conditions:

1) The 2nd petitioner/A2 is directed to surrender before the Station House Officer, Jannaram Police Station,

Ramagundam District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the 2nd petitioner/A2 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the 2nd petitioner/A2 shall appear before the concerned Station House Officer on every Monday between 10.00 A.M to 1.00 P.M for a period of eight weeks, for the purpose of investigation.

3) The 2nd petitioner/A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Accordingly, the Criminal Petition against petitioner No.1/A1 is dismissed and allowed against petitioner No.2/A2. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
