THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO.12015 OF 2016 ORDER:

The Criminal Petition is filed under Section 482 Cr.P.C. to quash the order dated 04.08.2016 passed in Crl.M.P.No.1698 of 2016 in C.C.No.192 of 2015 on the file of the III Additional Judicial Magistrate of First Class at Rajahmundry.

Heard the learned counsel appearing for the petitioner/accused and the learned Additional Public Prosecutor, representing the State. It is represented that the Court below issued warrants since the petitioner could not comply with the directions of the Court below. In that view of the matter, the Criminal Petition is disposed of directing the petitioner/accused to appear before the Court below and file fresh petition under Section 70(2) Cr.P.C. for recalling warrant and the Court below shall dispose of the said petition on the same day on usual terms.

Pending miscellaneous applications, if any, shall stand closed in consequence.
