O R D E R
Aggrieved by the action of the respondents in trying to acquire the part of the subject property of the petitioner for the purpose of road widening without initiating land acquisition proceedings under the provisions of the Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act'), the present writ petition is filed.
Heard the learned counsel for the petitioner. Sri V.Satyam Reddy, learned Standing Counsel for the 2nd respondent - Corporation, on instructions, submits that notice will be issued to the petitioner, and the respondents will follow the due process of law before acquiring the subject property of the petitioner for the purpose of road widening.
Heard the learned Assistant Government Pleader for Municipal Administration for 1st respondent.
Having regard to the facts and circumstances of the case and the submissions of the learned Standing Counsel for the 2nd respondent, writ petition is disposed of directing, that as and when notice is issued, it is open for the petitioner to file explanation raising all the objections, and the respondents / competent authority, shall consider the said explanation, and take appropriate action in accordance with law. Till then, no coercive steps shall be taken against the subject property of the petitioner.
Interlocutory applications pending, if any, shall stand closed. No order as to costs.
