THE HON'BLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.10927 OF 2025 ORDER:

This criminal petition is filed by the petitioneraccused seeking regular bail in connection with Cr.No.97 of 2025 of Vemulawada Rural Police Station, Rajanna Sircilla District. The offences alleged against the petitioner are under Sections 74, 75, 77, 351(2) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS').

The case of the prosecution is that the de-facto complainant lodged a report with the police on 06.08.2025, stating that he married one Gajarla Sunitha in the year 2018. After their marriage, they were blessed with two female children. Since some days, the accused followed defacto complainant's wife-Sunitha, wherever she went and harassing her to fulfill his lust, Sunitha informed the complainant about this, and upon receiving the information, the complainant and his family members strongly rebuked the accused. However, the accused behavior did not change. On 03.08.2025, the accused

called the complainant's wife over phone and threatened her stating that she should cooperate with him for a physical relationship otherwise he would share their combined photos on WhatsApp and other social media platforms. As such, the complainant requested the police to take necessary action against the accused.

Heard Sri Mahesh Muddala, learned counsel for the petitioner and Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing for the respondent-State. 4.

Learned counsel for the petitioner contended that the petitioner is innocent of the alleged offence. He is an agricultural labourer, earning a meagre livelihood, and his aged parents are solely dependent on him for their survival. He has been in jail since 07.08.2025; as such, he prays the Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed the bail stating that due to the harassment by the petitioner, the de facto complainant's wife committed suicide. In her statement, she clearly made allegations against the petitioner, and the investigation is

not yet complete. As such, the petitioner is not entitled to bail and prayed for dismissal of the petition. 6.

Considering the submissions made by both counsel and the material on record, the offences alleged against the petitioner are under Sections 74, 75, 77, and 351(2) of the BNS. As seen from the record, the petitioner is in jail since 07.08.2025, and the investigation is done by the investigating authority. This Court deems it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), each with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class Rajanna Sircilla District at Vemulawada.

ii.

The petitioner shall appear before the SHO concerned at 11:00 a.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, pending, if any, shall stand closed.
