HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23756 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondent Nos.2 to 5 in not registering the complaint of the petitioner dated 05.07.2018, against respondent Nos.6 to 8 and in interfering with the civil disputes of the petitioner. Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that on 17.07.2018, the husband of the petitioner gave a letter saying that he does not require any action against the complaint which was made earlier to the Commissioner of Police, Warangal, on 05.07.2018; and that the same was also entered in the General Diary on 17.07.2018.

Learned counsel for the petitioner submits that the petitioner never gave any letter for withdrawal of the complaint to the respondents.

It is to be seen that petitioners are the complainants and the respondent police have to act only on the complaint of the petitioners but not on the letter given by the husband of the first petitioner. More so, petitioners also assert that they have not withdrawn the complaint.

In view of the above, the competent authority is directed to take action on the complaint of the petitioners dated 05.07.2018, by following the guidelines of the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 25.07.2018 t k.
