Heard Sri A. Mahadev, for petitioners, and the Assistant Government Pleader (Home) for Respondents 1 and 2. None appeared for 3rd Respondent.

the petitioner prays for mandamus declaring the action of the 2nd Respondent in interfering with the possession and construction undertaken by the petitioner at premises bearing No.7-89/ 1, Kondurg village & Mandal, Mahabubnagar District, as illegal, arbitrary and unconstitutional.

On 20.01.2012 the Respondents were directed not to interfere with the construction work undertaken by the petitioner at subject premises. The order is subsisting as on date. 4.

The 2nd Respondent filed counter-affidavit and at Para-3, on the alleged interference, he replies as follows: " It is respectfully submitted that this Respondent never interfered with the civil disputes of petitioner and 3rd Respondent herein with regard to the construction activities of the petitioner with regard to the premises bearing No.7-89/ 1, at Kondurg village & Mandal, Mahboobnagar district, at any point of time." 5.

The statement of the 2nd Respondent is placed on record, and the writ petition is disposed of by making the interim order as

final order in the writ petition. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
