Aggrieved by the action of the 4th respondent in not passing orders on the petitioner's appeal, which was filed against order in LTR Case No.2/2017/GDL, dated 27.01.2018 passed by the 2nd respondent, this Writ Petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for respondents 1 to 4.

The grievance of the petitioner is that aggrieved by the order passed by the 2nd respondent in LTR Case No.2/2017/GDL, dated 27.01.2018, he filed appeal along with stay petition before the 4th respondent on 09.02.2018. As no orders are passed, present Writ Petition is filed.

Learned counsel for the petitioner submits that during pendency of appeal and stay petition before the 1st respondents, the respondents are trying to evict the petitioner under the guise of orders dated 27.01.2018 passed by the 2nd respondent. In view of above facts and circumstances, without expressing any opinion on the merits of the case, since the appeal and stay petition filed by the petitioner is stated to be pending before the 4th respondent, the 4th respondent is directed to dispose of the appeal stay petition filed by the petitioner against order passed by the 2nd respondent in LTR Case No.2/2017/GDL, dated 27.01.2018, as expeditiously as possible, after issuing notice to

the affected parties and after affording an opportunity of hearing.. Till disposal of the same, status quo obtaining as on today shall be maintained.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
