M. Mohan Rao, v. The State Of A.P.,
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 40063 OF 2015 BETWEEN M.Mohanrao ... PETITIONER AND The State of Andhra Pradesh, rep. by its Principal Secretary and others ...RESPONDENTS Date of Order pronounced: 10.12.2015 ORDER:- Heard learned counsel for the petitioner and Mr. D. Ramesh, learned Standing Counsel for CRDA.
2. The grievance of the petitioner in this writ petition is inaction of respondent Nos.2 to 6 in sanctioning and refusing the amount with regard to Ac.0-62 cents in Survey Nos.511 and 516 of the Thullur Village and Mandal, Guntur District, under the land pooling scheme of respondent No.3.
3. Petitioner claims to be an assignee of the said lands and is stated to have been given the lands under the land pooling scheme to respondent No.3 and, as such, the grievance is inaction of respondent No.3 in
sanctioning and refusing the amount to the petitioner with reference to the said land. Though the relief is sought for against respondent Nos.2 to 6, in reality the relief sought for is only against respondent No.3.
4. Learned Standing Counsel has received instructions from respondent No.3 which state that the lands, in question, are assigned lands and as per survey the petitioner was not found in possession. However, the competent authority is verifying the revenue records and would enquire the eligibility of the petitioner and issue appropriate directions as per the said enquiry.
5. Since the enquiry is contemplated, obviously, petitioner would be heard by respondent No.3 before taking any decision in the matter. Hence, suffice it to direct respondent No.3 to conduct appropriate enquiry, hear the petitioner and then take appropriate decision in the matter expeditiously. With the above direction, writ petition is accordingly disposed of. As a sequel the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
