:I{ON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.7947 of 2Al9 ORDER:

Petitioners, who are A.2 to A5 in Cr.No.388 of 2019 on the file of the S.H.O. Milis Colony Police Station, Warangal City, registered for the offence punishable under Section 395 IPC, filec1 this petition under Sections 437 and 439 Cr.P.C. seeking regular bai1.

Heard learned counsel for the petitioners/A2 to A5 and the learned Additional Public Prosecutor appearing for the respondent State.

Tht: case of the prosecution is that on 23.11.2019 at 8.40 hours, while the de facto complainant was proceeding on his tractor towards Shantinagar and reached near.Railway Gate, four unknown persons came on black colour scooty, way laid him and' beat him indiscriminately and robbed an amount of Rs.3,000/- from him. On seeing the people gathering there, they left the place. Basing on the complaint, police registered the above case.

Learned counsel for the petitioners submits that the allegations are baseless and there is no iota of evidence and the petitioners are falsely implicated in this case. He further submits that the petitioners are 1aw abiding citizens and they har.e not committed the offence. He further submits that the petitioners are residents of SRR Thota,

Warangal and hence, there is no chance of tampering with the evidence. He further submits that in this case entire investigation is completed, except filing ol charge sheet and hence, he prays to grant bail to the petitioners. 5.

On the other hand, the learned Additional Public Prosecutor representing the State vehemently opposed the bail application.

Looking into the nature of allegations leveled against the petitioners and also taking into consideration of the fact that A1 was already released on bail as per the orders of this Court, dated 11.12.2019 in Crl.P.No.7870 of 20 19 and the case of the petitioners also stands on the same lootingas that of A1,l am inclined to grant bail to the petitioners.

Accordingly, the Criminal Petition is allowed and the petitioners-A2 to A5 shall be released on bail on each of them executing a personal bond for a sum of Rs. 15,000/- with two sureties each for a like sum to the satisfaction of I Add1. Judl. Magistrate of I Class, Warangal.
