Petition is filed under Sections 391 to 394 of the Companies Act,1956 (for short 'the Act'). From the date of filing company petition till date the matter has undergone number of adjournments and the requirement of law is that the scheme of amalgamation is considered only when Sections 391 to 394 of the Act are completely pleaded and satisfied.

Having regard to the rigor of the statute, learned counsel requests the Court to permit the petitioner to withdraw the company petition with liberty to file a fresh petition for approval of scheme of amalgamation with latest details and figures.
