This writ petition is filed by the petitioner under Article 226 of Constitution of India, seeking to quash the proceedings in C.C.No.31 of 2015 on the file of the VII Special Metropolitan Magistrate, Erramanzil. 2.

Heard and perused the material available on record. 3.

In the above C.C., the petitioner-accused is alleged to have committed the offence under Section 138 of the Negotiable Instruments Act. Admittedly, the dispute in the above case is between two individuals, viz., the petitioner and the 2nd respondent. The State is not a party to the dispute between the parties. Therefore, the present writ petition is not maintainable.

Accordingly, the Writ Petition is dismissed as not maintainable. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
