THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1844 of 2016 ORDER:

This Criminal Petition is filed by the petitioners under Section 482 Cr.P.C seeking to quash the proceedings in C.C. No.546 of 2014 on the file of the XIV Metropolitan Magistrate, Cyberabad, L.B. Nagar, for the offence under Sections 498-A, 506, 420 and 406 IPC and 3 & 4 of Dowry Prohibition Act.

Heard the learned counsel for the petitioners and the learned Public Prosecutor and perused the material available on record. The allegations against the petitioner are that they harassed their daughter - in - law (daughter of the de facto complainant) physically and mentally demanding additional dowry.

After arguing for some time, learned counsel for the petitioners while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court. Considering the facts and circumstances of the case, the Criminal Petition is disposed of with the following directions: The presence of petitioners herein is dispensed with before the trial Court except on the date on which the trial Court is insisted for the presence and the trial Court is directed to proceed with the trial in the C.C.No.546 of 2014 and to dispose of the case as expeditiously as possible. The petitioners shall be properly represented through their counsel before the trial Court on all hearing dates. Miscellaneous petitions, pending if any, shall stand closed.
