HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.1769 of 2015 ORDER :

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the petitioner/plaintiff aggrieved by the docket order dated 16.12.2014, in I.A.No.1108 of 2014 in O.S.No.1017 of 2013, passed by the XXIV Additional Chief Judge, City Civil Court, Hyderabad, allowing the application filed by the respondents/defendants, under Section 148 C.P.C., r/w. Section 151 C.P.C., seeking to enlarge time for filing written statement, by setting aside the order dated 2.7.2014.

2. Heard learned counsel for the petitioner/plaintiff and perused the impugned order.

3. If the written statement is not filed within the time prescribed under law, it is always open for the Court to extend time for filing written statement, if sufficient reasons are shown for not filing the written statement within the time prescribed.

4. In view of the reasons assigned by the Court below, I do not find any illegality in the impugned order, warranting interference by this Court, under Article 227 of the Constitution of India.

5. This civil revision petition is devoid of merits and is accordingly dismissed, at the admission stage. Interim order granted by this Court on 19.6.2015 is vacated. As a sequel, miscellaneous petitions pending, if any, shall

stand closed. No order as to costs.
