THE HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.No.27287 OF 2019 JUDGMENT:

This writ petition is filed questioning the action of the respondents 3 to 5 in interfering with the peaceful possession and enjoyment of the petitioners property admeasuring Acs.6.31 gts., in Sy.No.260 situated at Maqdumpally Village, Bibinagar Mandal, Ydadri Bhongir District by conducting the survey for formation of road through the petitioners' land with the influence of respondents 7 to 12 and consequently to direct the respondents 3 to 5 not to conduct any survey without following the procedures contemplated under the Land Acquisition Act.

It is the case of the petitioners that they are the owners and possessors of the subject land and the official respondents 3 to 5, under the influence of unofficial respondents 7 to 12, un-authorisedly entered into the lands of the petitioners and taking steps for surveying the land without issuing any notice and without having any proper authorization issued by the Government. Aggrieved by the said action, petitioners filed the present writ petition. Upon written instructions given by the Revenue Division Officer, Bhongir, the learned Government Pleader would submit that the land pertaining to the writ petitioners in

TA,J MACMA.No.27287 of 2019 Sy.No.260 of Maqdumpally village of Bibinagar Mandal was not acquired.

Recording the same, this writ petition is disposed of. However, there shall be a direction to the official respondents 3 to 5 not to interfere with the peaceful possession and enjoyment of the lands of the petitioners, without following due process of law.

Accordingly, this writ petition is disposed of.

There shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
