O R D E R
As per the writ averments, the petitioner who is claiming to be one of the legal heirs of the original protected tenant for the subject land, filed appeal under Section 90 of A.P. (Telangana Area) Tenancy and Agricultural Land Act, 1950, in F2/9117/2013 before the Joint Collector, Nalgonda, against the order passed by the Tahsildar B.Pochampally in Proceedings No.B/506/2013-2 dated 1.7.2013. By order dated 13.9.2013 the Joint Collector, Nalgonda while staying the order of the Tahsildar dated 1.7.2013 directed him to submit the remarks and records of the case by 28.9.2013. Now, due to bifurcation of Districts in the State of Telangana, the subject matter was transferred from Joint Collector Nalgonda District to the 2nd respondent - Joint Collector Yadadri District. The petitioner filed a memo dated 30.12.
2016 before the 2nd respondent to fix the date of hearing in the appeal for its early disposal. Aggrieved by the inaction of the 2nd respondent - Joint Collector in considering the memo dated 30.12.2016 filed by the petitioner for fixing the date of hearing for disposal of the appeal, the present writ petition has been filed.
The learned Assistant Government Pleader for Revenue submits that due to bifurcation of Districts as the appeal has been transferred from Joint Collector, Nalgonda to the 2nd respondent - Joint collector, Yadadri District, fresh notices have to be issued for fixing the date of hearing of the appeal.
Having regard to the above facts and circumstances and the submissions of the learned counsel, the writ petition is disposed of at the admission stage, directing the 2nd respondent - Joint Collector, Yadadri District, to dispose of the appeal filed by the petitioner in F2/9117/2013, in accordance with law after issuing notices to all the parties to the appeal, within a period of three months from the date of receipt of a copy of this order. No costs.
