HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6805 OF 2017 ORDER:

The writ petition is filed seeking to declare the action of the respondents in threatening to demolish the constructions made by the petitioner situated in Plot Nos.8 and 21/A, Mini Industrial Estate, Hafeezpet village, Miyapur, Hyderabad as illegal and arbitrary and consequential direction to the respondents not to interfere with the possession and enjoyment of the petitioner's property. Heard both sides.

The case of the petitioner is that it is carrying on lawful business in its land, but however, the respondent authorities are repeatedly harassing the petitioners on one pretext or the other, which forced the petitioner to approach this Court. On earlier occasion, the petitioner herein filed W.P.Nos.8576 of 2011 and 9441 of 2016 before this Court, wherein this Court granted protection to the petitioner. Once again, the respondent authorities without there being any written orders are harassing the petitioner threatening to demolish the constructions, which have been made by the petitioner.

Learned Standing Counsel for respondents 2 and 4 submits that the writ petition is filed only on mere apprehension. However, the petitioner can be assured that

no coercive action, as such, would be taken, without following due process of law.

The submission made on behalf of the respondent authorities is made part of the record and with the above, making it clear that any action that is to be taken against the petitioner i.e., strictly, in accordance with law. Accordingly, the writ petition is deposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
