THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27289 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ, Order or direction more particularly one in nature of Writ of Mandamus declaring the action of the 2nd respondent in rejecting the building application dt.04.07.2018 through online intimation dt.22.03.2019 as arbitrary, illegal and contrary to provision of Greater Hyderabad Municipal Corporation Act and also law laid down in Hyderabad Potteries Case reported in 2001(3)ALT 200 and set-aside the same and consequently direct the respondents to consider petitioner application for grant of building permission and pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case." 2.

Heard Sri S.Sridhar, learned counsel appearing for the petitioner and Sri Sampath Prabhakar Reddy, learned standing counsel appearing for the respondents. Perused the material available on record.

When the matter is called, it is submitted by learned counsel for both sides that the issue in the present writ petition is squarely covered by the orders, dated 02.12.2019, in W.P.Nos.25385 of 2019 & 25389 of 2019 of this Court, wherein insisting of No Objection Certificate from the revenue officials is not required.

Following the said orders and for the reasons stated therein, this Writ Petition is also allowed in terms thereof, by setting aside the order impugned. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
